“Reduced an unreasonable RM900,000 maintenance claim to RM15,000.”

I acted for a husband in a divorce after a short marriage that had broken down almost immediately. The parties never lived together, and despite attempts at reconciliation through the Marriage Tribunal, the relationship could not be saved. When the husband filed for divorce, the wife counterclaimed and demanded a lump sum maintenance of RM900,000, an amount that was clearly excessive given that she was financially independent and gainfully employed.

I advised my client to stay firm against the unreasonable claim and presented arguments to show that the wife’s demand was disproportionate and unjustified.

The Court dissolved the marriage and instead ordered a fair lump sum maintenance of RM15,000, protecting my client from an undue financial burden.

I acted for a wife in a divorce after more than 20 years of marriage and three children. She had discovered her husband’s affair with a colleague, but the evidence was not strong enough to support a contested adultery claim in court. As a full-time housewife fully dependent on her husband, I advised her that an out-of-court settlement would best protect her interests.

She secured custody of the two younger children, monthly maintenance of up to RM10,000, and a RM1.3 million education fund for her children. The family home was ordered to be sold at a fair minimum value, with proceeds shared equally after repayment of loans. She also obtained and retained key assets in her name, ensuring her long-term financial security.

I acted for a husband in a joint divorce petition involving two young children. The case was sensitive, with allegations of the wife’s extra-marital affairs in dispute. My focus was on protecting my client’s parental rights, financial position, and property interests while avoiding an unnecessarily long and hostile battle.

Through negotiations and eventual court approval, both parties agreed to joint custody and guardianship, with the wife given care and control of the children but my client granted full and unrestricted access. My client agreed to pay RM2,000 per month in child maintenance — a fair figure reduced from the wife’s initial higher demand.

On the financial side, I successfully secured my client’s full entitlement to the main matrimonial property. The Court ordered that the property be sold and all proceeds given solely to him, while he only needed to reimburse the wife RM8,626 for loan payments she had made. Importantly, there were no orders for spousal alimony, protecting my client from ongoing financial exposure.

How do you charge for your services?

Yes. Even if one spouse does not agree, a contested divorce petition can still be filed and determined by the Court.

A joint petition may take just a few months. A contested divorce can take longer, depending on disputes over custody, maintenance, or property.

Spouses who apply for joint divorce are not required to attend counselling. A spouse who intends to file for a contested divorce usually must attend counselling at the Marriage Tribunal unless exempted.

For a joint petition, usually only one short hearing is required. For contested divorces, several hearings may be necessary.

My client got into an argument with his co-owner who rented out their jointly owned property without prior discussion or consent.

As a co-owner, my client argued that the tenancy agreement should not be valid without his consent. Because of that, he wanted to terminate the agreement and evict the tenant.

So, I represented my client and filed a case in court to challenge the legality of the tenancy agreement that’s only signed by 1 co-owner.

Halfway through the court case, I’ve successfully negotiated a settlement for both the co-owners to sell off the property to the tenant instead.

This client came to me after failing to receive the payment from the sale of his property. But it’s not the buyer’s fault. To make matters worse, my client has handed over the keys, and the buyer has already moved in too.

In Malaysia, when you buy a property, you normally would transfer the money to your appointed lawyer first. Your lawyer then has a duty to hold the money and release it to the seller after completing the transaction. But unfortunately in this case, the buyer’s lawyer ran away with the money.

That’s why it’s very important to hire a trustworthy lawyer to handle your property transactions. Considering that my client has fulfilled all their legal obligations for the sale, I decided to attempt an out-of-court settlement with the buyer.

After multiple meetings, I’ve successfully negotiated for a second payment directly to my client despite that the buyer had already paid to the previous lawyer.

I helped a client recover his family land from a group of tenants who are occupying it.

The client’s family rented out a piece of land to a group of tenants around the seventies and eighties. The agreement allows the tenants to occupy and build houses on the land.

However, there’s no expiry or duration mentioned in the agreement. This became the main dispute when my client terminated the agreement.

The tenants argued that they were allowed to occupy the land forever as long as they pay the rent every month.

So, I filed a case in the Session court and won by proving that the agreement is a license, not a lease. By law, owners can terminate licenses without a fix period at any time by giving sufficient notice.

Dissatisfied with the result, the tenants appealed the case to the High Court and then again to the Court of Appeal. But I still won the case in all of the Courts mentioned above.
